* TERMS AND CONDITIONS:
Promoter & Supplier: BHEN&CO Real Estate ABN 60629140816 and stated in the below conditions as “BHEN&CO”.
All dollar amounts are in Australian Dollars.
SALES:
- The property must be listed, sold and settled with an exclusive Agency Agreement with BHEN&CO.
- $500 is redeemable via voucher only, not cash.
- Voucher payable upon settlement date of the specific property’s campaign.
- Your choice of business for which the voucher shall be purchased. BHEN&CO will support many differing businesses for the purchase of the voucher, though the final decision towards the voucher purchase will remain with BHEN&CO.
- If you decide you prefer BHEN&CO donates $500 to an organisation, sporting club, charity or RSL of your choice, then said organisation must supply BHEN&CO with both a tax invoice & receipt of payment for tax purposes.
RENTALS:
- Entry is only open to Australian residents.
- Employees and immediate families of the Promoter & Supplier are ineligible. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step child (whether natural or by adoption), parent, step-parent, brother, sister, step-brother, or step-sister.
- One entry awarded to Referrer, per person bringing property[s] under BHEN&CO management.
- One entry awarded to Owner, per property brought under BHEN&CO management.
- Any one person can gain multiple entrants into the draw, one entrant awarded per valid eligibility criteria.
- To be an eligible the property to be managed by BHEN&CO must be within 25kms of Adelaide’s CBD.
- To be eligible for entry you must fall into one of the following 3 categories:
a) Referrer providing proof of introduction to BHEN&CO to a person whom then successfully brings their investment property under BHEN&CO management.
b) Owner transfers currently tenanted property to BHEN&CO and signs a 2 year authority for BHEN&CO to take over the management of the current tenancy agreement.
c) Owners signs a 2 year authority for BHEN&CO to source and secure a new tenant and manage vacant property, becoming valid once a tenant signs a min. 12 month tenancy agreement.
- For entrant to remain valid for prize draw, the specific property must remain under management by BHEN&CO during the draw date. If entrant withdraws their specific property from BHEN&CO’s management, as a result you will withdraw from the prize draw.
- The Promoter reserves the right to refuse to take on the management of a property for any reason whatsoever, including but not limited to reasons such as financial viability, property maintenance, and existing tenancy issues.
- Promotion commences 1st July 2022 at 9am ACDT.
- Promotion closes at 50 entrants.
- The winners will be drawn randomly.
- Both winners will be drawn from the same collective bucket.
- Two individual person winners to be drawn. Each receiving a $5,000 voucher prize.
- One person can not win both prizes. The first drawn winner is invalid in the second draw [Even if they have earned multiple tickets and still have entrants remaining in the draw].
The first winning ticket does not participate in the second draw. Meaning the first draw is 1 winner from 50 entrants, and the second draw is 1 winner from 49 entrants [minus any invalid entrants as per above].
In the event an invalid entrant is drawn in the second draw, this ticket will be disposed of, and a new ticket will be selected from the bucket, until such time a new person is drawn to win.
- The winners of the main $5,000 voucher prize will be notified by phone, email and/or social media. After confirmation the winner’s name will be promoted on BHEN&CO’s social media and website.
- All entrants accept participation in a video production for marketing purposes. eg, the winner will participate in testimonial video to tell their story of BHEN&CO managing their rental(s) and to openly discuss how the winner plans to utilize their prize.
- The Promoter’s decision is final, and no correspondence will be entered into.
- The specific shop or agency to which the $5,000 voucher is to be purchased by the Supplier & redeemable by the winner is to be determined solely by the Promoter.
- Any costs, fees or expenditure above the $5,000 voucher amount will be at the full responsibility of the winner and only the winner.
- In the event of war, terrorism, state of emergency, disaster or any other circumstance beyond the control of the Promoter, the Promoter reserves the right to either provide an alternative prize to the same value as the original prize, or subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion.
- From the time the winner is drawn and presented their prize the Promoter will not be liable for loss of the prize, or any matter related to the scheduling and/or itinerary plans related to the prize.
- The Promoter will not be responsible for any incorrect, inaccurate, or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.
- Tax implications may arise from the receipt or use of a prize. Independent financial advice should be sought. It is a condition of accepting the entrant allocation that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
- The prize, or any unused portion of this prize, is not transferable or exchangeable and cannot be taken as cash.
- If the prize is unavailable, the Supplier, in its discretion, reserves the right to substitute the prize with an alternative of same value.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonable anticipated due to any reason beyond the control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from regulatory authority, to modify, suspend, terminate, or cancel the promotion, as appropriate.
- The Promoter will not be liable or responsible for any of the following:
a) any technical difficulties resulting in inability to register your interest and miss opportunity to gain entry into the promotion.
b) any theft, unauthorized access or third party interference.
c) any entry prize claim that is late, lost, altered, damaged, or misdirected (whether or not their receipt by the Promoter or Supplier) due to any reason beyond the reasonable control of the Promoter and Supplier.
d) any variation of prize value to that stated in these Conditions.
e) any tax liability incurred by the winner or entrant; or
f) use of the prize.
- This promotion is governed by and is to be construed in accordance with the laws of South Australia. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of South Australia and waives any right to object to proceedings being brought in those courts.
